A contract for the purchase and sale of real estate that carries with it the obligation of the seller to convey title in fee simple is breached when the seller fails to convey the property with boundaries sufficiently delineated to allow the purchaser to transfer it to other parties. Where the damages established by the purchaser consist of the costs to obtain county approval of a boundary adjustment and of his inability to transfer or refinance the property while the boundary line adjustment process was pending, the trial courts application of the benefit of the bargain measure of damages is not inappropriate. Given the lack of argument or citation to authority to the contrary, we will not overturn either that measure of damages or its calculation.
